Wage & Hour Rights and Responsibilities

Wage Payment: Employee rights consist of:- Spend for all wages earned (INFO # 3) at the rate consented to by the company and staff member.

– Pay of at least minimum wage (INFO # 1), the applicable Colorado or local base pay, and all made overtime earnings without impermissible reductions from their incomes;.

– Pay of all earned earnings without impermissible deductions (INFO # 16).

Labor Statutes, Rules, & Published Guidance

Statutes & Rules: DLSS enforces a number of Colorado’s wage and hour and other kinds of labor statutes and labor guidelines, consisting of the Colorado Wage Act, the Colorado Overtime and Minimum Pay Standards (” COMPS Order”), and the Equal Pay for Equal Work Act. Please visit the Division’s Labor employment Statutes and Labor Rules web pages for existing and previous variations of key Colorado labor statutes and rules.

Published Guidance: The Division’s primary types of public guidance are:- INFOs (Interpretive Notices and Formal Opinions) – the Division’s officially authorized notifications, opinions, and descriptions on numerous labor law topics; and.

– KNOWLEDGEs (Knowledge for Workers on Labor Law is Empowering & Drives Good Employment) one-page summaries for staff members on their labor rights.

Written Demands, Complaints, & Investigations

Demands & Complaints for Wages: If an employer owes you incomes, you can send your employer a written demand for payment of incomes by mail, e-mail, text message, or other electronic means. A written demand may be sent to the employer at the exact same time a Labor Standards Complaint Form for unpaid incomes is submitted with the Division. The Labor Standards Complaint Form can be found on our Demands, Complaints, Responses, and Settlements website.

Employer Responses in Investigations: Once a total Labor Standards Complaint Form is received and evaluated, a letter describing the nature of the complaint and the amounts alleged to be owed is sent to the company. Investigations Launched by the Division (” Direct Investigations”): The Division might conduct employer-wide direct examinations of prospective offenses of Colorado wage and hour law. If you would like to send a suggestion, please email the Division at cdle_di_tips@state.co.us. If you want to file an individual claim for unsettled earnings, you must fill out a Labor Standards Complaint Form on our Demands, Complaints, Responses, and employment Settlements website. To appeal a direct examination citation or several Notices of Assessment, an alleged employer may send a Direct Investigation Appeal Form.
