Employment-Based Immigration: first Preference EB-1
You might be qualified for an employment-based, first-preference visa if you are an alien of remarkable ability, are an outstanding professor or scientist, or are a certain multinational executive or . Each occupational category has certain requirements that need to be fulfilled:
Your petitioning company needs to be a U.S. company and intend to utilize you in a supervisory or executive capacity. The petitioner needs to have been doing business in the U.S. for at least 1 year, as a legal entity with a qualifying relationship to the entity that utilized you abroad in a managerial or executive capacity.
No labor certification is required.
* Criteria for Demonstrating Extraordinary Ability
In order to show you have sustained nationwide or international acclaim which your achievements have been recognized in your field of competence, you should either include proof of a one-time achievement (significant internationally-recognized award) or 3 of the 10 noted requirements listed below (or comparable evidence if any of the criteria do not readily use):
– Evidence of receipt of lesser nationally or globally recognized prizes or awards for excellence
– Evidence of your subscription in associations in the field which demand impressive achievement of their members
– Evidence of published material about you in expert or major trade publications or other significant media
– Evidence that you have been asked to evaluate the work of others, employment either separately or on a panel
– Evidence of your initial clinical, academic, creative, athletic, or business-related contributions of significant significance to the field
– Evidence of your authorship of scholarly articles in expert or major trade publications or other significant media
– Evidence that your work has actually been displayed at creative exhibits or displays
– Evidence of your performance of a leading or critical role in distinguished companies
– Evidence that you command a high wage or other considerably high remuneration in relation to others in the field
– Evidence of your business successes in the carrying out arts

** Examples of Documentary Evidence That an Individual is an Exceptional Professor or Researcher
In order to demonstrate you are an outstanding professor or scientist, you should include evidence of 2 of the 6 listed criteria listed below (or similar evidence if any of the criteria do not readily apply):
– Evidence of invoice of major employment prizes or awards for impressive accomplishment
– Evidence of membership in associations that need their members to show outstanding achievement
– Evidence of released product in professional publications written by others about the alien’s operate in the academic field
– Evidence of participation, either on a panel or separately, as a judge of the work of others in the exact same or allied academic field
– Evidence of original clinical or academic research study contributions in the field
– Evidence of authorship of scholarly books or articles (in scholarly journals with international blood circulation) in the field

Application Process
Extraordinary Ability: You might get yourself by filing a Type I-140, Petition for Alien Worker.
Outstanding Professors and Researchers: Your U.S. company should file a Type I-140, Petition for Alien Worker. As part of the application procedure, your company needs to have the ability to demonstrate a continuing capability to pay the used wage as of the concern date. Your employer may use a yearly report, federal earnings tax return, or audited monetary statement to demonstrate a continuing ability to pay your wage.
Multinational Manager or Executive: Your U.S. employer must submit USCIS Form I-140, Petition for Alien Worker.
